An expungement is the process in which, if successful, the Court will “erase” the records of one’s arrest, conviction and/or entry into a diversionary program. DUI expungements typically are available after one has been granted entry into the ARD program (read more about ARD here) and has completed it successfully. At that point in time, a DUI expungement lawyer would file the required forms and paperwork in order to submit the expungment to a Judge for review. The Commonwealth has the ability to object to the expungement if they feel it is appropriate, which would then necessitate a Court hearing.
Once the expungement has been granted, the Court’s Order is sent to all of the related law enforcement agencies directing them to destroy the records of the related case.
